dc.description.abstractLa Sala de Casación Social del Tribunal Supremo de Justicia, afirmó en las sentencias números 858-2014 de 7 de julio y 266-2010 de 23 de marzo, que las utilidades se calculan con baseen el salario normal promedio devengado en el año, y, que el salario integral conformado por elsalario normal más las alícuotas de Utilidades y bono vacacional, es la base para el cálculo de laantigüedad. Este trabajo, enmarcado dentro del género ensayo de tipo crítico, utilizando la investigaciónbibliográfica-documental e histórico-comparativa, persigue poner en evidencia los erroresimplícitos en tal doctrina y demostrar que las utilidades se calculan con base en la noción ampliadel salario y que las prestaciones sociales se calculan con base en la misma noción, adicionandolas alícuotas de utilidades y bono vacacional; lo que incide en los costos laborales de las entidadesde trabajo, incrementándolos, pero constituye un mandato legales_VE

This article, framed inside the critical essay genre, usingthe bibliographic-documentary and historical comparative investigation, pursues to put inevidence the implicit mistakes about this doctrine and demonstrate that the utilities are calculatedbased in the wide notion of the salary and that the social benefits are calculated basedin the same notion plus the utilities aliquots and holiday bonus; the incident on the labor costof work entities, increases them but it constitutes a legal orderes_VE
