La seguridad social: inicio del estado de bienestar. Especial referencia al caso venezolano

Abstract
La Seguridad Social fue determinante para la aparición del Estado de Bienestar o Estado Social de Derecho: Este derecho humano se encuentra dentro de los derechos económicos, sociales y culturales y está consagrado en normas de rango supraconstitucional y constitucional. Se puede observar que el artículo 86 de la Constitución de la República Bolivariana de Venezuela es programático e impone una obligación inmediata al Estado, al consagrar "(...): El Estado tiene la obligación de asegurar la efectividad de este derecho, creando un sistema de seguridad social (...). Desde la entrada en vigencia del nuevo texto constitucional, hasta la presente fecha se puede observar que el Estado venezolano, ha transgredido el artículo 86 constitucional al no poner en operatividad el sistema de seguridad social, ocasionando el no - cumplimiento de los fines del Estado.

Since the new constitutional text came into effect up until the present day, the Venezuelan State has broken the constitutional article 86 by not putting into practice the social security system. By not doing this, the State has not met its purposes. |
